Charge Cycle Notices
Hard copy invoices are sent to all accounts. Payment is required by 'Due Date'
as stated on invoice.

General Use Policy
General
Millennium Computers of Western New York, Inc. offers Internet Access and
related services through its system to its subscribers. Millennium Computers of
Western New York, Inc. does not and cannot control the content, quality or
accuracy of information available through its system(s) or over the Internet in
general. These terms and conditions of sale set forth the basic rules which
apply to Millennium's services and use of its system. Millennium Computers of
Western New York, Inc. may change these terms and conditions of sale in the
future upon notice published on-line or otherwise provided by Millennium
Computers of Western New York, Inc. from time to time. If any change to the
terms or conditions of sale, Millennium's service, system or pricing is
unacceptable to a subscriber, the subscriber may terminate its account in
accordance with Section 5 below.
Lawful Use
Millennium's services and system may only be used for lawful purposes and
consistent with all rights of other parties. Without limiting the foregoing,
Millennium's services and system shall not be used in a manner which would
violate any law or infringe any copyright, trademark, trade secret, right of
publicity, privacy right or any other right of any person or entity or for the
purposes of transmitting or storing of material which is obscene, libelous or
defamatory. Use and access to other networks through Millennium's system must
comply with the rules for such other networks.
Changes to Service
The services provided by Millennium Computers of Western New York, Inc. are
expected to change from time to time. Millennium Computers of Western New York,
Inc. reserves the right to change any service offered or the features of any
service offered or its system without notice, including changes to access and
use procedures, such as idle disconnections, and system hardware and software.
Payment Terms
A subscriber must pay fees per Millennium's rate schedule in effect from time to
time as a condition to obtaining access to Millennium's services and system.
Rate changes will be effective when published on-line or otherwise provided to
subscribers. Payment terms of monthly fees are due on 'Due Date' as indicated
on invoice. Accounts that are three or more days past due are considered
delinquent. Delinquent accounts are subject to immediate suspension and/or
termination without notice. Accounts that are thirty or more days delinquent
are considered canceled and will be terminated.
Termination and Suspension
Either subscriber or Millennium Computers of Western New York, Inc. may, at its
sole discretion, terminate the subscriber's account at any time with or without
reason. Millennium Computers of Western New York, Inc. also may, at its sole
discretion, suspend a subscriber's account at any time with or without reason.
Monthly charges will not be prorated. TERMINATION OR SUSPENSION DOES NOT
RELEASE LIABILITY FOR CHARGES DUE. Millennium Computers of Western New York,
Inc. may delete all data, files or other information that is stored in
subscriber's account upon termination.
No Warranty;
Limitation of Liability
Use of Millennium's services and system and the internet in general is at user's
sole risk. Millennium Computers of Western New York, Inc. does not warrant that
its services and system will be uninterrupted or error free; nor does Millennium
Computers of Western New York, Inc. make any warranty as to the results or
information obtained from use of its service or system or the internet in
general.
Millennium's services and system are
provided on an "as is", "as available" basis without warranties of any kind,
either expressed or implied, including implied warranties of merchantability or
fitness for a particular purpose, all of which warranties are hereby expressly
disclaimed except to the extent any warranty cannot be disclaimed under
applicable law. Under no circumstances shall Millennium Computers of Western
New York, Inc. be liable for any indirect, incidental, special or consequential
damages, including, without limitation, loss of profits. The maximum liability
of Millennium Computers of Western New York, Inc. to any subscriber or user for
any and all loss, claim, damage or liability of any kind, including due to
Millennium's negligence, shall be limited to the amount paid by the subscriber
or user to Millennium Computers of Western New York, Inc. during the six month
period preceding the claim.
Indemnity
The subscriber agrees to indemnify and hold harmless Millennium Computers of
Western New York, Inc., its directors, officers, shareholders, agents, employees
and its other subscribers from any and all claims, liabilities, damages, or
expenses, including attorney fees, arising out of or resulting from any and all
use of subscriber's account whether or not authorized.
Non-Transferability
Subscriber's account and right to use Millennium's services and system is not
transferable without Millennium's consent. Subscriber agrees to protect its
password and account and to keep them secure from unauthorized users and use.
Confidentiality
Electronic mail and other transmissions passing over the internet and through
Millennium's system are not confidential. Accordingly, Millennium Computers of
Western New York, Inc. cannot guarantee the protection or privacy of any
information of any user. Millennium Computers of Western New York, Inc.
reserves the right to monitor a user's mail and transmissions as a necessary
incident to providing service and otherwise to protect the rights or property of
Millennium Computers of Western New York, Inc. Millennium Computers of Western
New York, Inc. will not disclose any such information unless required to do so
pursuant to a court order, subpoena, or similar legal request or otherwise on
the advice of counsel.
Interpretation
These terms and conditions supersede all other written and oral communication or
agreements with regard to the subject matter. A waiver or modification of these
terms and conditions shall only be effective in in writing, signed be an
authorized officer of Millennium Computers of Western New York, Inc. These
terms and conditions shall be governed by and interpreted in accordance with the
laws of the State of New York without regard to choice of law principles.
Subscriber Agreement
Billing Agreement: All customers are
billed in advance as outlined and selected below. All customers are billed from
the date they are activated to the date they are terminated.
Millennium Computers of Western New York, Inc. will maintain a customer service
department to handle any billing disputes which are submitted by a subscriber
whether by telephone, in writing or by e-mail. Once notice of changes have been
displayed over the service, Millennium Computers of Western New York, Inc.
reserves the right to adjust this agreement, price structure, operating
regulations and/or may cease or revise any or all aspects of the service without
prior notice. Unless otherwise agreed, subscriber's rights to use the service
or to appoint users is not transferable and is subject to any limits established
by Millennium Computers of Western New York, Inc., or by a subscriber's credit
card company if billing through a credit card. Subscribers shall pay, in
accordance with the provisions of the Billing Option selected by the minimum
charges and other charges incurred by the subscriber or its designated users at
the rates in effect for the billing period in which these occurred, including
but not limited to charges for any purchases made through the Service and any
surcharges incurred using any supplemental networks or networks or services
other than the Service. Subscribers shall pay all applicable taxes relating to
use of the Service by member or its designated users. Subscribers shall be
responsible for all use of the Service accessed through the subscriber's or its
designated user's password(s).
Warranty: Subscribers will be responsible
for and must provide all equipment including but not limited to computer, modem,
telephone, etc. Necessary to access the service. Subscribers nor their assigned
users may reproduce, retransmit, redistribute, transfer, publish or commercially
capitalize on any information, software or general content which they receive
via the service. Neither Millennium Computers of Western New York, Inc. nor any
of its content providers, licensers, employees or agents warrant that the
service will be uninterrupted or error free; make any warranty as to the results
to be obtained from the use of the service. The service is distributed on an
"as is" basis without warranties of any kind, either expressed or implied.
Neither Millennium Computers of Western New York, Inc. nor anyone else involved
in creating, producing or delivering the service shall be liable for any direct,
indirect, special or consequential damages developing out of the use of the
service. Subscribers expressly acknowledge that the provision of this agreement
shall also apply to the third party content.
Non-Sufficient Funds: Checks returned for
Non-sufficient Funds will bed debited against the customer's account and a fee
of $25.00 for each returned check will be charged against the customer's
account.
Email Use Policy
Sending unsolicited mail messages,
including, without limitation, commercial advertising and informational
announcements, is explicitly prohibited.
A user shall not use another site's mail
server to relay mail without the express permission of the site.

Password
Change
When was the last time you changed your
password? You should change your password periodically for security reasons.
Passwords must be at least 6 digits in
length. We recommend using a combination of alpha and numeric characters.
Here are a few guidelines to follow when
choosing a password:

One of the weakest methods of security
is to just add a digit to a real word or your username. The weakest method is
to make your password the same as your username or use the word "password" as
your password. These are some of the first things a hacker checks for.

Real words can be discovered through
common cracker dictionary programs. These programs compare your password to
all of the words in the dictionary. If you need to use a common word, try an
alternate method of spelling it. For example, use 'fut' for 'foot', spell
'ball' as 'bal'. Or you can substitute numbers for some of the letters, '0'
for 'o', '1' for 'L', and so on.

If I were a hacker and saw a username
like 'Batman', I would immediately think of Robin or Joker as choices for the
user's password. It is best to use something totally unrelated as a
password. If you must use something related, try using a mixture of letters
plus digits.

If your password consists of a special
date (like your birthday or anniversary), try adding in some letters with your
numbers. For example, if your birthday was 070971, try ju for July, then
0971, then ly. Your password would become ju0971ly.
Remember to write your new password down
and keep it in a safe place. If you forget your password, we will not be able
to tell you what you chose. You will need to contact Millennium Computers and
choose a new password.
When changing your password, the mail
change takes place immediately. The login authentication change may take up to
five minutes to migrate to the Authentication Server.
The following rules apply to the Referral
Program:

Free months are given for New
accounts only. A new account is defined as anyone who does not currently and
has not had any type of account with Millennium Computers. A second account
for you or someone you previously received a referral for does not qualify as
a new account.

The new account must complete a
minimum of 1 month of service.

Members of any special programs do
not receive free referral months for other members of the same program.

The referring subscriber's account
must be current and in good standing.
-
A credit will be issued for any
free months you receive for new account referrals. This credit may be applied
to you next renewal amount.

Referral requests must be received
within 30 days of the New account registration.
-
The referring account will receive
a credit memo in the mail when they receive their free month. The credit memo
will contain the name of the person who was referred.
*Maximum value not to exceed $17.95 per
referral.

below. Customers outside of these areas may be able to extend their local
calling area with Regional Calling. For more information on regional calling,
please contact your local telephone company.

distance or toll charges. Millennium Computers of Western New York, Inc. will
not be responsible for any long distance or toll charges you may incur by

Please note the above phone exchanges very carefully. Make sure you can
call the phone number as a local call. If you are a Verizon customer and you
can call one of the above cities listed locally, then you can call the dial-up
numbers listed as a local call. Only call the exchange of the city that is
local to you unless you want to pay regional phone charges.
If you are NOT a Verizon customer (if you are serviced by a small local phone
company), then be very careful. Some of them may not recognize the Tonawanda,
Buffalo, Niagara Falls, Albion, Angola, Batavia, Boston, Derby, Dunkirk, Eden,
Holland, Lockport, Medina, Olean, Springville, Wanakah, and Wellsville exchanges
as being a local call. If they do not, they will charge you for a long distance
charge. If that is the case, you should complain to your phone company that
Verizon customers can call the numbers local, so you should be able to too.
If you are charged for long distance calls when
dialing into us, you are responsible for those charges. Millennium Computers is
NOT responsible for any long distance charges you may incur.
